1. Bidding: Each lot will be sold to the highest bidder, with reserve. All buyers must be registered on line prior to bidding via internet. On-site buyers must register for a bidder number. All buyers must be 18 years of age or older.
2. Bidding disputes: The auctioneer in charge will settle any bidding disputes.
3. Terms: Payment from successful bidders is due immediately upon the conclusion of the sale. Buyers present at the sale location shall make payment on-site at the conclusion of the sale. On line bidders shall mail a check or money order no later than the day following the sale (Feb. 3, 2022) to 15372 Antelope Creek Rd., Rapid City, South Dakota 57703. All checks should be made payable to Gordon Howie.
4. Possession: Immediately after each lot is sold, is becomes the sole risk and responsibility of the successful bidder.
5. Transfer of Title: All animals will be transferred to successful bidders at the expense of the Sale Host.
6. Guarantees: Guarantees and representations are strictly between buyers and consignors (sellers). The Sale Host and Auctioneer are acting as representatives of the consignors, who are solely responsible.
7. Notice: Buyers must look solely to the seller for fulfillment of all guarantees and representations, NOT the sale host or auctioneer.
8. Announcements: All announcements or changes of information at time of sale take precedent over any previously published or promoted information.
9. Contract: When the auctioneer declares the successful bidder on each lot, it becomes a contract between buyer and seller, subject to any consignor reserve.
10. Transportation: All lots are located at the ranch of the individual consignors. Buyer is responsible to make immediate contact with the consignor to make arrangements for pick-up of the purchased lots. Buyer is responsible for arranging paying for transportation.
11. Health papers: Consignors will provide appropriate health papers at the time the animal is picked up for transportation.
Clicking to bid is a binding contract. Successful winning bids constitute as final sales. No refunds available. Hauling is organized and funded at the owner's expense. If payment is made by credit card there is a 4% transaction fee.
